申請者應遵守下列各項規定，若有違反之情事發生，所有之責任概由申請者負責。The applicant shall comply with the following provisions. The applicant is responsible for liability in case of any violation.

1. 申請電信管制射頻器材或非隨插即用射頻模組（組件）/電信終端設備或非隨插即用限制性通信模組審驗者，應檢附之文件或物品誤漏或不全時，驗證機關（構）應通知申請者於一個月內補正；屆期未補正或補正仍不完備者，駁回其申請。
前項申請經審驗不合格者，驗證機關（構）應列舉不合格事項，通知申請者於二個月內改善，並向原驗證機關（構）申請複審；屆期未申請複審或複審仍不合格者，駁回其申請。
Regarding the applications for approval of CTRFD , non-plug-and-play radio-frequency modules (components), TTE or non-plug-and-play restricted communications module, in case the of an incomplete or missing document or required item, the certification body shall inform the applicant to undertake corrective action within one month; failure to do so within the prescribed period shall result in the rejection of the application.
For applications that have failed approval as mentioned in the preceding paragraph, the certification body shall draw a list of failed items and inform the applicant to undertake corrective action within two months and apply for a secondary review to the original certification body; failure to apply for secondary review within the prescribed period or failure of the secondary review shall result in rejection of the application.

2. 驗證機關（構）依電信管制射頻器材審驗管理辦法或信終端設備審驗管理辦法規定駁回申請時，申請者所繳交之前條費用不予退還。
In the case where the application is rejected by the certification body according to these Regulations Governing Compliance Approval for Controlled Telecommunications Radio-Frequency Devices or Regulations Governing Compliance Approval for Telecommunications Terminal Equipment, the fee paid by the applicant as mentioned in the preceding article shall not be returned.

3. 取得型式認證證明、符合性聲明證明或簡易符合性聲明證明者，應妥善保管申請審驗之電信管制射頻器材或非隨插即用射頻模組（組件）、外接電源、配件、外接天線、與檢驗報告或測試報告相符之測試治具及與檢驗報告或測試報告使用相同版本之測試軟體至該器材停
止生產或停止輸入後五年。但電信管制射頻器材或非隨插即用射頻模組（組件）於一般正常使用時未使用外接電源、配件、外接天線或測試時未使用測試治具、測試軟體，得無須保管外接電源、配件、外接天線、測試治具或測試軟體。
Those that have been issued a type approval certificate, DoC certificate or simplified DoC certificate shall keep the approved CTRFD or non-plug-and-play radio-frequency module (component), external power supply, accessories, external antenna, test fixture that complies with the examination or test report and the test software of the same version as in the examination or test report properly for five (5) years after the device is no longer produced or imported. For the external power supply, accessory and external antenna of the CTRFD or non-plug-and-play radio-frequency module (component)
that is not used in the normal use mode or the test fixture or program that is not used in testing, it is not necessary to keep such an external power supply, accessories, external antenna, test fixture or software.

4. 取得型式認證證明或符合性聲明證明者，應妥善保管申請審驗之電信終端設備或非隨插即用限制性通信模組、外接電源、配件、外接天線、與檢驗報告或測試報告相符之測試治具及與檢驗報告或測試報告使用相同版本之測試軟體至該設備停止生產或停止輸入後三年。但電信終端設備或非隨插即用限制性通信模組於一般正常使用時未使用外接電源、配件、外接天線或測試時未使用測試治具、測試軟體，得無須保管外接電源、配件、外接天線、測試治具或測試軟體。
Those that have been issued a type approval certificate, DoC certificate or simplified DoC certificate shall keep the approved TTE or non-plug-and-play restricted communications module, external power supply, accessories, external antenna, test fixture that complies with the examination or test report and the test software of the same version as in the examination or test report properly for three (3) years after the equipment is no longer produced or imported. For the external power supply, accessory and external antenna of the TTE or non-plug-and-play restricted communications module that is not
used in the normal use mode or the test fixture or program that is not used in testing, it is not necessary to keep such external power supply, accessories, external antenna, test fixture or software.

5. 電信管制射頻器材或非隨插即用射頻模組（組件）/電信終端設備或非隨插即用限制性通信模組之取得審驗證明者，於相關技術規範修正，並限期重新申請審驗時，應申請重新審驗，並得使用原審驗合格標籤或符合性聲明標籤。
Regarding a CTRFD ,non-plug-and-play radio-frequency module (component) ,TTE or non-plug-and-play restricted communications module issued with an approval certificate, an application for new approval shall be submitted when the relevant technical specifications are amended and such an application is required; the original approval label or DoC label may be used.

6. 電信管制射頻器材或電信終端設備取得審驗證明者、被授權使用審驗合格標籤或符合性聲明標籤者，應依下列規定辦理，始得販賣：
一、於本體明顯處標示審驗合格標籤或符合性聲明標籤及其型號，並於包裝盒標示主管機關標章。最終產品應於本體明顯處標示非隨插即用射頻模組（組件）之審驗合格標籤及最終產品型號，並於包裝盒標示主管機關標章。最終產品應於本體明顯處標示非隨插即用限制性通信模組之審驗合格標籤及最終產品型號，並於包裝盒標示主管機關標章。
二、依主管機關或相關技術規範規定於指定位置標示正體中文警語。
前項標籤、型號或正體中文警語標示顯有困難，經主管機關核准者，應依主管機關核准方式標示。
A CTRFD or TTE that has been issued compliance approval certificate and for which the use of compliance approval label or DoC label is licensed shall not be sold until the following process has been followed:
(1). The compliance approval label or DoC label and model number are indicated on the body where it is clearly visible, and the logo of the competent authority on the packaging. For final products, the compliance approval label of non-plug-and-play radio-frequency module (component) and the model number of final product shall be indicated on the body where it is highly visible, and the mark of the competent authority on the package box. For final products, the compliance approval label of non-plug-and-play restricted communications module and the model number of final product shall be
indicated on the body where it is highly visible, and the mark of the competent authority on the package box.
(2). Warning(s) in traditional Chinese shall be indicated at the location specified by the competent authority in the applicable technical specifications.
For difficulty of indicating labels, model number or warnings in traditional Chinese mentioned in the preceding paragraph, the indication shall be done as approved by the competent authority, provided that the approval of the competent authority has been obtained.

7. 審驗證明遺失、毀損或登載事項變更時，得檢附換（補）發申請書，向原驗證機關（構）申請補發或換發
Regarding a lost or damaged certificate or change of information in the certificate, an application for renewal / replacement may be submitted to the original certification body for application of renewal / replacement.

8. 驗證機關（構）得隨時抽驗取得審驗證明之電信管制射頻器材或非隨插即用射頻模組（組件）/電信終端設備或非隨插即用限制性通信模組。
主管機關得指示驗證機構抽驗特定電信管制射頻器材或非隨插即用射頻模組（組件）/電信終端設備或非隨插即用限制性通信模組。
前二項抽驗得由主管機關指定抽驗項目。
驗證機關（構）辦理電信管制射頻器材或非隨插即用射頻模組（組件）/電信終端設備或非隨
插即用限制性通信模組抽驗時，應於市場購買，並得檢附相關購買證明向取得審驗證明者請求支付購買費用，取得審驗證明者不得拒絕。但市場無法購得樣品者，得命取得審驗證明者無償提供。
A certification body may perform an inspection on a CTRFD , non-plug-and-play radio-frequency module (component) ,TTE or non-plug-and-play restricted communications module for which the compliance approval certificate has been issued.
The competent authority may instruct a certification body to perform an inspection of a specific CTRFD , non-plug-and-play radio-frequency module (component) ,TTE or non-plug-and-play restricted communications module.
Regarding the sampling inspection mentioned in the two preceding paragraphs, the competent authority may specify the item(s) of inspection.
When a certification body is performing an inspection on a CTRFD , non-plug-and-play radio-frequency module (component) ,TTE or non-plug-and-play restricted communications module, the sample shall be purchased from the market and proof of purchase may be provided to those that have been issued the approval certificate for reimbursement of the purchase cost. Those that have been issued the certificate shall not refuse such as reimbursement request. In the case where it is impossible to acquire a sample from market, those that have been issued the certificate may be requested to
provide the required sample(s) at his own cost.

9. 取得審驗證明者，經發現其申請時所檢附之電信管制射頻器材、非隨插即用射頻模組（組件）、電信終端設備或非隨插即用限制性通信模組、外接電源、配件、外接天線、資料或其電子檔案偽造或虛偽不實時，主管機關或原驗證機構得撤銷其審驗證明。
In case that the CTRFD, non-plug-and-play radio-frequency module (component) ,TTE ,non-plug-and-play restricted communications module external power supply, accessory, external antenna, data or electronic file submitted by those that have been issued the approval certificate for the application for approval was falsified or deliberately misleading, the approval certificate of the competent authority or original certification body shall be revoked.

10. 審驗證明經撤銷或廢止者，自撤銷或廢止日起三個月內，原取得審驗證明者不得就同一電信管制射頻器材或非隨插即用射頻模組（組件）/電信終端設備或非隨插即用限制性通信模組向驗證機關（構）重新申請審驗，主管機關並得將原取得審驗證明者及撤銷或廢止事由公告之。
審驗證明經撤銷或廢止時，原取得審驗證明者、經授權使用審驗合格標籤或符合性聲明標籤者，應依主管機關指定期限回收已販賣之電信管制射頻器材或非隨插即用射頻模組（組件）/電信終端設備或非隨插即用限制性通信模組，若他人權益因而受損，並應負損害賠償責任。
依前項應辦理回收而拒不辦理回收或有回收不確實情形時，原取得審驗證明者自主管機關通知日起六個月內，不得就同一電信管制射頻器材或非隨插即用射頻模組（組件）/電信終端設備或非隨插即用限制性通信模組向驗證機關（構）申請審驗。審驗證明經撤銷或廢止者，其申請時檢附之檢驗報告或測試報告，自撤銷或廢止日起失其效力。
Regarding an approval certificate which has been withdrawn or revoked, those that have been issued the certificate shall not apply for a new approval for the same CTRFD , non-plug-and-play radio-frequency module (component) ,TTE or non-plug-and-play restricted communications module to a certification body within three months starting from the day of withdrawal or revocation; the competent authority may announce those that have been issued the approval certificate and the reason(s) of withdrawal or revocation.
On the withdrawal or revocation of approval certificate, those that have been issued the certificate and those that have been licensed for the use of compliance approval label of DoC label shall recover the CTRFD , non-plug-and-play radio-frequency module (component) ,TTE or non-plug-and-play restricted communications module that have been sold by the deadline specified by the competent authority, shall be responsible for compensation for damage to the interests of others, if any.
For failure of recovery as specified in the preceding paragraph or inappropriate recovery, those that have been issued the approval certificate shall be forbidden from submitting an application for the approval of the same CTRFD , non-plug-and-play radio-frequency module (component) ,TTE or non-plug-and-play restricted communications module to a certification body for six (6) months starting from the day of receiving a notice from the competent authority.
For the withdrawal or revocation of a compliance approval certificate, the examination or test report submitted for the application shall cease to be effective on the day of withdrawal or revocation.

11.主管機關得揭露取得審驗證明之電信管制射頻器材或非隨插即用射頻模組（組件）/電信終端設備或非隨插即用限制性通信模組之廠牌、型號、審驗證明、外觀照片、不含內部及電路板照片之檢驗報告或測試報告等審驗相關資料。以取得審驗證明之完全射頻模組（組件）組裝之完全最終產品，主管機關得揭露該完全最終產品之廠牌、型號及其外觀照片。取得審驗證明者有前項外觀照片等審驗資料之保密需求時，得向原驗證機關（構）申請設定保密。但經主管機關或原驗證機構確認，其電信管制射頻器材或非隨插即用射頻模組（組件）/電信終端設備或非隨插即用限制性通信模組業於國內、外公開陳列或販賣者，不受理其申請。
申請設定保密者經主管機關或原驗證機構確認，其電信管制射頻器材或非隨插即用射頻模組（組件）/電信終端設備或非隨插即用限制性通信模組業於國內、外公開陳列、販賣或逾保密期限未申請展期者，由原驗證機關（構）至主管機關指定網站揭露相關資料。
第二項保密期間自驗證機關（構）設定日起最長一年，必要時，得於保密期間屆滿前十四日起七日內申請展期，展期最長為一年並以二次為限。
The competent authority may disclose the make, model number, approval certificate, appearance photographs, examination or test report without the photographs of the interiors and circuit board, and other review information of the CTRFD , non-plug-and-play radio-frequency module (component) ,TTE or non-plug-and-play restricted communications module for which the approval certificate has been issued. For a full final product that is assembled with a full RF module (component) for which an approval certificate has been issued, the competent authority may disclose the make and model number of
the full final product and its photographs.
In the case where those that have been issued an approval certificate has the need of confidentiality for the appearance photographs or other information mentioned in the preceding paragraph, an application for confidentiality may be submitted with the original certification body. However, the application shall be rejected if it is confirmed by the competent authority or original certification body that the said CTRFD , non-plug-and-play radio-frequency module (component) ,TTE or non-plug-and-play restricted communications module has been on display or sold publicly domestically or in other nations.
For those who applied for confidentiality, In the case where it is confirmed by the competent authority or original certification body that the said CTRFD , non-plug-and-play radio-frequency module (component) ,TTE or non-plug-and-play restricted communications module has been on display or sold publicly domestically or in other nations, or that the confidentiality period has expired without request for extension, the original certification body may disclose relevant information at a website specified by the competent authority.
The confidentiality period mentioned Paragraph 2 is valid for a year at maximum starting from the day that the confidentiality is approved by the certification body. An application for extension of confidentiality period, if necessary, may be submitted within seven (7) days starting from fourteen days prior to the expiration; the extension shall be a year at maximum and no more than two (2) extensions shall be granted.

12. 審驗過程中產生的產品的符合性質疑，申請者須提出符合相關要求的證明；如經要求須檢送審驗器材樣品時，應儘速提供之。
Any doubt/problem found in the process of certification for compliance, the applicant shall be ready to provide necessary evidence to prove the compliance. If the sample is required to provide, the applicant should send it as soon as possible.

13. 申請者始終符合驗證要求(例如:支付審驗費用、提供已獲驗證產品變更之資訊、為追查活動提供取得已獲驗證產品之管道)，包括被本驗證機構通知後因應NCC新的產品驗證要求而實施適當地修正。
The applicant always fulfills the certification requirements (for example, remit the certification fee, provide information of engineering change on the certificated product, inform the way to access the certificated product for market surveillance activity), including implementing the appropriate changes when they are communicated by the RCB (Dekra).

14. 如驗證適用於持續性之生產，已獲驗證產品持續符合產品驗證要求(例如:法規、標準及技術規格)
If the certification applies to ongoing production, the certified product continues to fulfill the product requirements (eg. Regulations, standards, and technical specifications.).

15. 本驗證機構如因產品驗證而有相關要求，申請者要為下述項目，做所有必要之安排：
When the RCB (Dekra) requests due to product certification needs, the applicant shall make all necessary arrangements for:
(1). 執行評估(符合性評鑑活動之選擇與決定功能的結合)與追查(如有要求時)，包括提供檢查文件與記錄，以及取得相關設備、場所、區域、人員及申請者分包商之管道；
the conduct of the evaluation (selection of conformity assessments activities and combinations of decision function) and surveillance (if required), including provision for examining documentation and records, and access to the relevant equipment, location(s), area(s), personnel, and applicant's subcontractors;
(2). 抱怨之調查；
investigation of compliants;
(3). 適用時，觀察員之參與。
The participation of observers, if applicable.

16. 申請者有關驗證之宣稱與驗證範圍一致(例如: 被授與驗證之產品、過程、或服務，適用之驗證方案，及判斷產品、過程或服務符合之標準與其他規範性文件，包括其發布日期) 。
The applicant makes claims regarding certification consistent with the scope of certification (eg. the product(s), process(es) or service(s) for which the certification is granted; the applicable certification scheme, and; the standard(s) and other normative document(s), including their date of publication, to which it is judged that the product(s), process(es) or service(s) comply).

17. 申請者不得以會損及本驗證機構聲譽之方式使用其產品驗證，也不得就其產品驗證，做出本驗證機構認為可能誤導或未獲授權之任何聲明。
The applicant does not use its product certification in such a manner as to bring the RCB (Dekra) into disrepute and does not make any statement regarding its product certification that the RCB (Dekra) may consider misleading or unauthorized.

18. 於驗證暫時終止、終止或結束時，申請者應停止使用包含任何引用驗證之所有廣告品，並採取驗證方案所要求之措施(如退回驗證文件)，以及採取任何其他要求之措施。
Upon suspension, withdrawal, or termination of certification, the applican discontinues its use of all advertising matter that contains any reference thereto and takes action as required by the certification scheme (e.g. the return of certification documents) and takes any other required measure.

19. 如申請者將驗證文件副本提供給其他人，文件應全部複製或如驗證方案所規定者。
If the applicant provides copies of the certification documents to others, the documents shall be reproduced in their entirety or as specified in the certification scheme.

20. 在傳播媒體，諸如文件、手冊或廣告中引用其產品驗證時，申請者應遵守本中心之要求或驗證方案之規定。
In making reference to its product certification in communication media such as documents, brochures or advertising, the applicant complies with the requirements of the RCB ((Dekra) or as specified by the certification scheme.

21. 申請者遵守可能於驗證方案中規定的，與符合性標章之使用，以及與產品資訊有關之任何要求。
The applicant complies with any requirements that may be prescribed in the certification scheme relating to the use of marks of conformity, and on information related to the product

22. 申請者有可能影響其符合驗證要求能力之變更時，及時通知本驗證機構。
The applicant informs the RCB (Dekra), without delay, of changes that may affect its ability to conform with the certification requirements

23. 對驗證機構安排稽核活動 (包含內外稽核), 並由對該稽核作業簽署了保密文件的評估人員/稽核者執行時，申請者應同意其取閱產品申請文件When assessment activities (including internal audit or external audit) for the certification body are arranged and performed by assessors/auditors who sign confidential document for the assessment, the applicant shall give consent for them to access the product application information.

需先mail到ctc.tw@dekra.com (備用mail：eva.chen@dekra.com)提出帳號註冊申請(申請時，需提供中、英文公司全名) ，請並詳閱下方使用條款，在提出申請的同時，表示您已同意下方的使用條款，待審核通過，將寄發帳號密碼與FTP投件網址。

型式認證網路申辦系統使用條款

1. 認知與接受條款

本公司係依據國家通訊傳播委員會所定法規及本使用條款，受理電信管制射頻器材、電信終端設備審驗網路申請作業（以下簡稱「申請案件」）。您（含申請案件申請人，以下亦同）利用本系統請型式認證網路申辦帳號，即表示您已閱讀、理解並同意使用條款之所有內容。本公司有權修改或變更使用條款內容，並公告於本服務網站上，請您隨時注意該等修改或變更。若您於任何修改或變更後繼續使用本系統，則視為您已閱讀、了解並同意接受該等修改或變更

2. 註冊義務：為使用本系統，您同意以下事項上傳最新、正確及完整的資料，如資料發生變動，請即時配合更新、並通知。

維持並更新前揭登錄資料及上傳資料之正確性及完整性，如登錄資料或上傳資料有錯誤或不實，本公司有權暫停或終止您的帳號，並依電信管制射頻器材審驗辦法、電信終端設備審驗辦法撤銷審驗證明。

3. 隱私權保障：您為使用本系統於上傳資料，僅供本公司處理申請案件使用，但主管機關法規(電信管制射頻器材審驗辦法、電信管制射頻器材驗證機構管理辦法、電信終端設備審驗辦法、電信終端設備驗證機構管理辦法)或其法規另有規定者，不在此限。

4. 帳號、密碼及安全：當您提出帳號申請後，我們將寄出一組密碼及帳號，您同意並承諾以下事項：您應維持此帳號及密碼的機密安全，您利用前揭密碼及帳號所進行的一切行為，您應負事實上及法律上責任。

當您發現上揭密碼及帳號被盜用或有其他問題時，您應立即通知本公司，如本公司為調查前揭事宜，您亦同意配合

5. 客戶在驗證過程中因驗證作業而遭致任何損失要求賠償時，驗證技術中心之賠償處理，於獲主管機構授權之合法的驗證作業範圍內，則循求國家賠償，於未獲主管機關授權之驗證作業範圍，則交由權責所屬地方法院執行評斷。

6. 申辦障礙處理 (系統中斷或故障)：為使用本系統，您同意以下事項：

本系統有時可能會出現中斷或故障等現象，或許將造成您使用上的不便、資料喪失、錯誤等情形。您於使用本服務時宜自行採取防護措施。
當本系統發生網路塞車、斷線或申請人端電腦當機的情況，導致順利將您的文件資料傳送到本系統主機端時，您同意在網路系統恢復正常後重新上傳資料。
當本系統因主機端電腦維修，導致暫時停止提供網路申辦作業服務時，您同意改以一般書面方式或改以備用e-mail辦理申辦作業。本公司對於您因使用（或無法使用）本系統而造成的損害，不負任何賠償責任。

7. 守法義務及承諾：您承諾遵守國家通訊傳播委員會所定相關法規、其他中華民國法規及一切使用網際網路之國際慣例，並保證不損害他人權益或為其他違法行為。審驗電子申辦作業執行後，稍後仍須提出[用印申請文件紙本正本]，請參閱申請者權利義務之申請者提供型式認證申請書正本文件之義務依據。

當您開始使用本服務時，即表示您已閱讀、了解並同意接受本服務條款之所有內容。
